Transplant bill passed its first reading in Parliament 

The Verkhovna Rada adopted bill No. 2457 on amendments to some legislative acts of Ukraine, which regulate the transplantation of anatomical materials to humans, as a basis.

326 MPs voted for the bill, a Ukrinform correspondent reports.

As Chairman of the Committee on Health of the Nation, Medical Aid and Medical Insurance Mikhail Radutsky noted at a meeting of the Verkhovna Rada, there is a need to postpone the launch of the transplant system in Ukraine until January 1, 2021 through the establishment of the Unified State Transplant Information System (ESTI), through which, in particular , a search will be made for the recipient donor.

At the same time, he emphasized the need to halve the deadlines for submitting proposals and amendments to the draft. 261 People’s Deputies voted for this decision.

The draft law proposes to determine that before the start of the work of the EHIS, but no later than January 1, 2021, the provisions of this Law on the use of this system to organize the provision of medical care using transplantation are not applied. Organization of transplantation is carried out on the basis of information contained on paper.


Changes are proposed in the regulation of hematopoietic stem cell transplantation, which will allow for the establishment of an effective mechanism for interaction with hematopoietic stem cell registries abroad and the use of non-state registries to fill in the national database of hematopoietic stem cell donors.

The draft law proposes to replace the central executive body that implements the state policy in the field of medical assistance with transplantation and carrying out activities related to transplantation with a focal point for transplantation – a specialized state institution that performs functions in the field of medical care with transplantation and carrying out activities related to transplantation, which is formed by the central authority and additional power, ensuring the formation and implementation of public health policy.

The bill establishes that the State Transplant Support Information System consists of the Unified State Transplant Information System and the State Hematopoietic Stem Cell Transplant Information System.

The document provides for the determination by regulations of regulations that are not sufficiently substantiated at the level of the Law from the point of view of the practice and effectiveness of the regulatory settlement.

In total, it is proposed to amend eighteen articles and two paragraphs of the final and transitional provisions of the Law of Ukraine “On the transplantation of organs and other anatomical materials to humans,” to clarify the norms relating to transplantation, the Fundamentals of the legislation of Ukraine on health care, to expand the development of medical science by making additions Article 6 of the Law of Ukraine “On Burial and Funeral”. In order to increase the protection of activities in the field of transplantation, it is proposed to detail the corpus delicti provided for in the first part of Article 143 of the Criminal Code of Ukraine, and to supplement the Code of Ukraine on Administrative Offenses with a new Article 452 on violation of the established procedure for entering information into the Unified State Transplantation Information System.
